Public Offer Agreement

On concluding a contract for the purchase and sale of goods

1. GENERAL PROVISIONS

1.1. This document constitutes an official public offer (the “Offer”) by Sole Proprietor Borysiuk Anna Vitaliivna (Tax ID: 3731609702), hereinafter referred to as the “Seller”, to conclude a distance sales agreement for the purchase and sale of goods via the website www.ganzen.store.

1.2. In accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine, this Offer is public. Acceptance of this Offer occurs when the Buyer places and pays for an Order on the Website.

1.3. The Agreement is deemed concluded at the moment of:

  • confirmation of the Order by the Buyer by clicking the order confirmation button; and

  • crediting of funds to the Seller’s bank account and/or confirmation of successful payment via a payment service provider.

1.4. Prior to completing payment, the Buyer must review this Offer and confirm agreement by checking the appropriate box.

1.5. The Seller reserves the right to amend this Offer. The updated version becomes effective upon publication on the Website.

 

2. TERMS AND DEFINITIONS

Buyer — an individual who places an Order
Product — clothing, accessories, and other goods presented on the Website
Order — a properly completed request to purchase a Product

 

3. SUBJECT OF THE AGREEMENT

3.1. The Seller undertakes to transfer ownership of the Product to the Buyer, and the Buyer undertakes to accept and pay for it.

3.2. All descriptions, specifications, and prices of Products are available on the Website.

3.3. Product photographs may slightly differ from the actual appearance due to color display settings and lighting conditions.

 

4. PRICES AND PAYMENT TERMS

4.1. All prices are indicated in Ukrainian Hryvnia (UAH).

4.2. The final payable amount is displayed to the Buyer before redirecting to the payment page and includes all applicable charges (product price, delivery fee, discounts).

4.3. Payment may be made by:

  • bank card via a secure Portmone payment page;

  • bank transfer;

  • cash on delivery via shipping service (if applicable).

4.4. The Seller does not collect or store payment card details. All payments are processed exclusively through secure payment service providers.

4.5. The Seller shall not apply hidden fees or increase the payment amount after Order confirmation.

 

5. DELIVERY

5.1. Delivery is carried out via shipping providers (e.g., Nova Poshta or other services indicated on the Website).

5.2. Delivery timeframes are agreed upon during Order confirmation.

5.3. The risk of accidental loss or damage to the Product passes to the Buyer at the moment of receipt.

5.4. The Buyer is obliged to inspect the Product’s completeness and condition upon delivery.

 

6. RETURNS AND EXCHANGES

6.1. The Buyer has the right to return a Product of proper quality within 14 calendar days from receipt in accordance with the Law of Ukraine “On Consumer Protection”.

6.2. Returns are accepted provided that:

  • the Product has not been used;

  • its original condition is preserved;

  • tags and proof of purchase are retained.

6.3. Return shipping costs are borne by the Buyer unless otherwise provided by law.

6.4. Refunds are processed within 30 calendar days from the date the returned Product is received, to the original payment method or another agreed method.

6.5. Products not eligible for return in accordance with Resolution of the Cabinet of Ministers of Ukraine No. 172 are not subject to return.

 

7. WARRANTIES AND LIABILITY

7.1. Warranty conditions are determined by the manufacturer and indicated on product labels or in product descriptions.

7.2. The Seller is not liable for defects arising from improper use of the Product.

 

8. CONFIDENTIALITY

8.1. Personal data is processed in accordance with the Law of Ukraine “On Personal Data Protection”.

8.2. Detailed information regarding personal data processing is available in the Privacy Policy published on the Website.

 

9. FORCE MAJEURE

9.1. The parties shall be released from liability for failure to perform obligations in case of force majeure circumstances (war, emergencies, technical failures, etc.).

 

10. DISPUTE RESOLUTION

10.1. Disputes shall be resolved through negotiations.

10.2. If no agreement is reached, disputes shall be resolved in accordance with the applicable legislation of Ukraine.
